Van Renon Art - Terms & Conditions

Please read these Terms and Conditions ("Terms") carefully before using the Van Renon Art website (www.vanrenonart.com). By accessing or using the Website, you agree to be bound by these Terms. If you do not agree to all of these Terms, then you may not access or use the Website.  

1. Definitions

  • "Van Renon Art," "we," "us," or "our" refers to the owner and operator of this Website, located in Ontario, Canada.

  • "Artwork" refers to the original works of art offered for sale on the Website.

  • "Customer," "you," or "your" refers to any individual or entity accessing or using the Website or purchasing Artwork.

  • "Content" refers to any text, images, videos, information, or other material displayed on the Website.

2. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Van Renon Art. Your access to and use of the Website signifies your acceptance of these Terms and any modifications or updates that may be posted on the Website from time to time. It is your responsibility to review these Terms periodically for changes.

3. Use of the Website

  • Eligibility: By using the Website, you represent and warrant that you are at least the age of majority in your jurisdiction and have the legal capacity to enter into these Terms.  

  • Prohibited Conduct: You agree not to use the Website for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Website or interfere with any other party's use and enjoyment of the Website. Prohibited conduct includes, but is not limited to:

    • Uploading or transmitting any viruses, malware, or other harmful code.

    • Collecting or harvesting any personally identifiable information from other users without their consent.  

    • Attempting to gain unauthorized access to any portion of the Website or any systems or networks connected to the Website.  

    • Using any robot, spider, scraper, or other automated means to access the Website for any purpose without our express written permission.  

    • Impersonating any person or entity or misrepresenting your affiliation with any person or entity.

    • Infringing upon the intellectual property rights of Van Renon Art or any third party.

4. Artwork Information and Pricing

  • Artwork Descriptions: We strive to provide accurate descriptions and images of the Artwork available for sale on the Website. However, please note that colours and details may appear differently depending on your monitor or device. We do not warrant that the descriptions, images, or other Content relating to the Artwork are entirely accurate, complete, reliable, current, or error-free.

  • Pricing: The prices for Artwork are listed in Canadian Dollars (CAD) and are subject to change without notice. Shipping costs and applicable taxes will be added to the purchase price at checkout.

  • Availability: The availability of Artwork is subject to change without notice. We reserve the right to remove or modify the listing of any Artwork at any time.

5. Ordering and Payment

  • Order Placement: By placing an order through the Website, you are making an offer to purchase the Artwork in your order. All orders are subject to acceptance by Van Renon Art. We may refuse to accept an order for any reason, including but not limited to unavailability of Artwork, errors in pricing or description, or suspicion of fraudulent activity.

  • Payment: We accept the payment methods specified on the Website. You agree to provide complete and accurate payment information and authorize us to charge your chosen payment method for the total amount of your order, including the purchase price, shipping costs, and applicable taxes.  

  • Order Confirmation: Once your order has been placed, you will receive an order confirmation email. This email confirms that we have received your order but does not constitute acceptance of your order. Your order is accepted when we ship the Artwork to you and send you a shipping confirmation email.  

6. Shipping and Delivery

  • Shipping Policy: Our shipping policy, which is incorporated into these Terms by reference, outlines the shipping methods, costs, and estimated delivery times. Please review our Shipping Policy carefully before placing an order.

  • Delivery: We will use commercially reasonable efforts to ship the Artwork to the address you provide during the ordering process. You are responsible for ensuring that the shipping address is accurate and complete. Risk of loss and title to the Artwork pass to you upon our delivery to the carrier.

  • Customs and Import Duties: For international orders, you are responsible for any customs duties, import taxes, fees, or other charges imposed by your country's customs regulations.



7. Returns and Refunds

  • Return Policy: Our return policy, which is incorporated into these Terms by reference, outlines the conditions under which returns and refunds are accepted. Please review our Return Policy carefully before making a purchase.

  • Original Condition: Returned Artwork must be in its original condition and packaging. You are responsible for the cost of return shipping.

  • Refunds: If your return is accepted, we will process your refund within a reasonable timeframe using the original payment method.

8. Intellectual Property

  • Ownership: All Content on the Website, including but not limited to the Artwork images, designs, text, graphics, logos, and software, is the property of Van Renon Art or its licensors and is protected by copyright, trademark, and other intellectual property laws.

  • Limited License: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Website for your personal, non-commercial use in accordance with these Terms.  

  • Restrictions: You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the Content on our Website without the prior written consent of Van Renon Art.  

9. Disclaimer of Warranties

THE WEBSITE AND ALL CONTENT, PRODUCTS, AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE WEBSITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.  

TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, VAN RENON ART DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE WEBSITE, THE ARTWORK, AND ANY OTHER PRODUCTS OR SERVICES OFFERED THROUGH THE WEBSITE. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE WEBSITE OR THE SERVERS THAT MAKE THE WEBSITE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.  

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VAN RENON ART, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE WEBSITE, THE ARTWORK, OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  

IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF VAN RENON ART TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE WEBSITE, THE ARTWORK, OR THESE TERMS EXCEED THE AMOUNT PAID BY YOU TO VAN RENON ART FOR THE SPECIFIC ARTWORK IN QUESTION.

11. Indemnification

You agree to indemnify, defend, and hold harmless Van Renon Art, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your breach of these Terms, your use of the Website, or your violation of any law or the rights of a third party.  

12. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.  

Any legal suit, action, or proceeding arising out of or relating to these Terms or the Website shall be instituted exclusively in the courts located in Durham, Ontario, Canada, and you irrevocably submit to the jurisdiction of such courts.  

13. Modifications to the Terms

Van Renon Art reserves the right to modify or update these Terms at any time without prior notice. Any changes will be effective immediately upon posting on the Website. Your continued use of the Website after the posting of revised Terms constitutes your acceptance of the changes.  

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable, and the remaining provisions of these Terms shall continue in full force and effect.  

15. Entire Agreement

These Terms, together with our Privacy Policy and any other policies or guidelines posted on the Website, constitute the entire agreement between you and Van Renon Art with respect to your use of the Website and supersede all prior or contemporaneous communications and proposals, whether oral or written.
